There are many different ways you can use our services – to be part of a safety community with welfare check-ins and be able to raise an alert. If you are an individual with Private contacts these terms apply to you. If you are a User within a Company or Organisation then your Company or Organisation controls your personal information as set out in this Privacy Policy.

We believe your fundamental rights to Privacy do not differ depending on where you live in the world. That is why we treat any data can identify you is termed “personal information”. Our processing of your information is in accordance with the General Data Protection Regulation 2016/679 (“GDPR”), and the California Consumer Privacy Act (“CCPA”) and the Australian National Privacy Principles.

This Privacy Policy explains what information Raise DM  and any authorized agent (together, “Raise DM ” or “We” and sometimes “Us”) collect about You and why, what we may do with that information and how we handle Your information.

We’ve tried to keep this policy as simple as possible. Your privacy matters to us; whether you are new to Raise DM or a long-time customer, please do take the time to get to know our practices – and if you have any questions, contact us at support@raisedm.io .

As you use our services, we want you to be clear how we’re using information and the ways in which you can protect your privacy. Raise DM  are committed to protecting Your privacy in Your personal information and the content that You create while using our Product(s) and Service(s).

What Is The Scope Of This Privacy Policy?

This Privacy Policy is incorporated into the Raise DM  Terms and Conditions and applies to the information obtained by Us through Your use of our Mobile Application SafeTAG CEC or other Product(s) and/ or Service(s) and any subscription you may have with us to our dashboards or web-based software. Capitalised terms used in this Privacy Policy not otherwise defined shall have the meanings provided for those terms in our Terms and Conditions.

Acceptance Of Terms

If You are Accessing, Downloading, Using or Purchasing our Product(s) or Service(s) You are deemed to have confirmed Your acceptance of this Privacy Policy and the Terms and Conditions and Your agreement to be a party to this binding contract including any modified or additional terms that Raise DM may publish from time to time. If You do not agree to this Privacy Policy and the Terms and Conditions, do not access or use any Product(s) and/or Service(s) including RAISE™ Licensed Application(s) and Web Tools.

For the purpose of this Privacy Policy, ‘Personal information’ includes any information that you voluntarily submit to us and that identifies you personally, including contact information, such as your name, e-mail address, phone number, and other information about yourself, together with location data. Personal Information can also include information about any transactions, both free and paid, that you enter into with Us. Personal information can also include the name, email and phone number of your Private Safety Contact/s. They will be invited to view and accept these terms and conditions to accept your invitation.

By providing personal information to us, you consent to Us collecting, holding, using and disclosing your personal information in accordance with this Privacy Policy. You do not have to provide personal information to Us, however, if you do not, it may affect your use of this Site or the Product(s) and Service(s) offered on or through it.

How We collect and manage Your personal information

We collect and manage your personal information in the following ways:

Information you give us.

We collect information about you when you register for an account with us, create or modify your profile, use, access, or interact with our services or our website (including but not limited to when you upload, download, collaborate on or share content, including images, documents and messages). Such content may include personal information, in timer notifications or messages, or other information that you choose to include.

Information you create

When you sign up for an account we’ll ask for personal information, like your name, email address, telephone number, if you pay for a service you will do this through an accepted payment provider such as Xero. We may present your name, email address, mobile phone number or image to other users in your group/organisation, or otherwise associated with your account in order to assist in actioning safety related needs, communicating with you or to facilitate the purposes of our Product(s) and Service(s).

We will ask you for permissions to access your precise location, camera and notifications, calendar (optional) and phone. If you do not grant us these permissions then the App will not function correctly or as intended.

If you invite a person to be a Private Safety Contact they will be contacted using the contact details created by You when using the Product(s) and Service(s).  They will be invited to download the SafeTAG CEC Application and agree to our Privacy Policy and other Terms and Conditions.  We use this solely for the purpose of providing our service to You and them.  You and/ or They can unsubscribe at any time. You can also delete your account and your data.

If you are part of an Organisation or Company Subscription you need to get in contact with your Company or Organisation regarding how they control your personal information.

Information we get from your use of our services.

We may collect information about the services that you use and how you use them. This information includes:

Device information – We may collect device-specific information (such as your hardware model, operating system version, unique device identifiers, and mobile network information including phone number). We may associate your device identifiers, email or phone number with your account.

Log information – When you use our services or view content provided by us, we may collect and store certain information in audit logs. This may include:

·         calling-party email ID, time and date of calls;

·         device event information such as crashes, system activity, the date and time of your request and referral URL;

Contact information – When you choose to use the Raise DM services to invite your own Private Contacts, to view an action or receive notifications, or be part of your safety protocols, we may collect, sync and store certain contact information such as name, phone number and email address. This information may be sent to our servers for the purposes of providing those members with an invitation to participate in the Raise DM services as directed by you.

Location information – When you use a location-enabled service, we may collect and process information about your actual location, like GPS signals sent by a mobile device. We may also use various technologies to determine location, such as sensor data from your device that may, for example, provide information on nearby Wi-Fi access points and cell towers.

Information types we Collect

We collect:

Both foreground location and background location -This is necessary to share your GPS during an ongoing alert and when using Follow Me.

Please note: We DO NOT track you when you start welfare timers until you are OVERDUE to check-in, or your choose to share your data such as activating an SOS or when using Follow Me. We share GPS as a one off event when using functions such as Report-in and Activity Log. We use precise location where possible, this is necessary to support you in the event of an emergency SOS and other alerts.

Web storage – We may collect and store information (including personal information) from your device using mechanisms such as web storage to facilitate the functions of the software such as Report-in.

How we use information we collect

We may use the information we collect, including your personal information and transaction information, from our services in any one or more of the locations we have operations in Australia or where your Company or Organisation conducts operations for the following purposes:

·         to provide, maintain, protect, improve, and personalise our services, to develop new ones and to protect the rights, property, or safety of Raise DM and our customers and users;

·         to communicate with you in order to provide you with information we think may be useful or relevant to you;

·         to promote our services and related services;

·         to enforce the Privacy Policy and our terms and conditions for use of our services and website;

·         to monitor and analyse trends, usage, and activities in connection with our services;

·         to investigate and prevent fraudulent transactions, unauthorised access to or use of our services, and other illegal or unusual activities;

·         when you contact us, to keep a record of your communication to help solve any issues you might be facing. We may use your email address to inform you about our services, such as letting you know about upcoming changes or improvements;

·         to combine information from one service, including personal information, into other services – for example to make it easier to share alerts from satellite communicators within your app, where you are a Safety Contact and also to your organisations dashboard;

·         as otherwise stated in this Privacy Policy.

To complete the functions and service we provide we may require our systems to access, screen capture, store, use your camera and/or share your information within the SafeTAG CEC platform. Where appropriate or required by data protection laws, we will ask for your consent before using information for a purpose other than those that are set out in this Privacy Policy.

Retention of Personal Data

We will retain your personal information for the time necessary to provide the services we perform for you, or to achieve other purposes outlined in this Privacy Policy, and you can always request that we stop processing or delete your personal information. If you are a User within a Company or Organisation they control the retention of your personal information.

We are required to keep some of your information for certain periods of time under law. When we no longer require your information, we will ensure that your information is destroyed or de-identified.

We may need to retain certain personal information after we cease providing you with products or services to enforce our terms, for fraud prevention, to identify, issue or resolve legal claims and/or for proper record keeping.

This policy is not intended to place any limits on what we do with data that is aggregated and/or de-identified so it is no longer associated with an identifiable user or Customer of the Services. We will not sell your personal information for any purpose.

Your privacy in Your content is a paramount concern for Us, and We will only access that content in order to provide our Services to You. There are limited circumstances in which We may have the need to review part or all of Your content, as discussed in this Privacy Policy, including to complete the functions of our platform.

Information we may request

We may ask You to provide personal information if You submit feedback to us. We will only do this:

·         to meet Your needs (e.g. answer a question)

·         to help us improve our service (e.g. demographic analysis)

·         if required by law. We may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Will Anyone Else See My Content?

We customarily disclose necessary personal information only to our trusted partners who assist us in operating the Products and Services. We will only disclose personal information to an unrelated third party with your consent, unless required by law.

Except as described here and in our Terms and Conditions, unless You are a member of an Organisation or Group license, or You elect to enable others to view or have access to the content e.g. Your Contacts accept your invitation and submit to the Service, no one else other than You or a Contact, should see Your content without Your consent. If you are a member of an Organisation or Company license, you consent to your Organisation or Company establishing an account on your behalf and they will have access to and store your information in accordance with their Privacy and data retention policies. If you are a member of a Group or Organisation who has set up your account, you are a User of a Customer and we do not control your personal information.

We include information here to help Customers provide notice to their Users about their data collection, processing and usage through SafeTAG CEC.

Disclosure of personal information outside Australia

Raise DM may transmit personal information through servers in some countries around the world. We may transmit your personal information through a server located outside the country where you live. If you are using SafeTAG CEC in another country or have members of your safety team or organisation in another country then We may disclose personal information outside of Australia to third parties for the purposes outlined in this Privacy Policy.

By providing us with personal information, you consent to the disclosure of your personal information to trusted partners who reside outside Australia to meet the purposes of the software. Where we disclose your personal information to trusted partners, we will take reasonable steps to ensure that any overseas recipient will deal with such information in a way that is consistent with the Australian Privacy Principles. NB: If you reside in Australia and do not travel out of Australia, and if you are a member of a Company or Organisation solely operating in Australia, all data created using SafeTAG CEC is stored in Australia.

In addition, Raise DM enables You to use a number of third-party services and applications that interact with our Product(s) or Service(s) and Your content, such as Google Maps and You should review their access rights You provide to those services or applications. Please refer to the privacy terms and conditions or license agreements of any third-party service such as Google Maps. 

Information we share

We do not sell your personal information. We do not unnecessarily share personal information with third parties unless one of the following circumstances apply:

When you join the Group or Organisation environment you are consenting to your personal information being shared with and controlled by your Account Manager, Company Manager(s) and Group Manager(s).

Access by Organisations as our Customers

If you are a member of an Organisation or Group Subscription, Your Organisation/ Group can control who receives your alerts and notifications and what is collected and or sent to you (other than when in Private Mode or to and from Private Contacts). When you use SafeTAG CEC, Group or Organisation contacts may include Group Emergency Contacts (GEC), GEC contacts receive information to achieve the purpose of the Product(s) or Service(s).

Your Organisation’s Company or Group Managers may be able to:

·         view statistics regarding your group account;

·         change your group account password;

·         suspend or terminate your group account access;

·         access or retain information stored as part of your group account;

·         receive your account information in order to satisfy applicable law, regulation, legal process or enforceable governmental request;

·         restrict your ability to delete or edit group related information.

View information and alerts to achieve the purpose of the Product(s) or Service(s) and your communication with them.

Raise DM does not control the content created or stored by a Customer Group or Organisation, such as GEC settings, group communications or our services provided through a corporate service dashboard/s. Raise DM does not control other types of information that our customers may choose to collect or manage or share using the Subscription Service. Customers determine their own policies for the sharing and disclosure of Customer Data including your personal information.

That information belongs to them and is used, disclosed and protected by them according to their privacy policies and is not subject to this Privacy Policy.

If you want to delete your account, you can do this through your App under the Profile tab, or using our webform (LINK).

Your Access to Your Personal Information

Raise DM acknowledges that you have the right to access your Personal Information controlled by us. Our customers control and are responsible for correcting, deleting or updating information they have collected from you as a User using a Subscription Service.

If requested to remove data we will respond within a reasonable timeframe. We may work with our Customers include information to help them provide notice to their members about their data collection, processing and usage.

Where such information includes personal information of a child under 13 please notify us of this fact and we will make every endeavour to remove their personal information as soon as possible. We are not responsible for our customers’ use of information they collect on the Subscription Service.

Access and correction and deletion

If you want to delete your account, you can do this through your App under the Profile tab, or using our webform (LINK).

If you are a User of a Customer Organisation, You will need to contact your Organisation/Company to delete any data controlled by them.

If any data contains unauthorised information of a child under the age of 13 years please contact us and we will assist you to remove the data. Please complete a request via admin@RaiseDM.io and this will be actioned within the shortest possible time, subject to this Privacy Policy.

Use and disclosure of personal information

We will not add You to a third-party mailing list, nor give Your personal information to unrelated third parties without Your consent, unless required by law. In addition, you consent and we are permitted to use or disclose personal information held about you:

·         Where we reasonably believe that the use or disclosure is necessary to lessen or prevent a serious, immediate threat to someone’s health or safety or the public’s health or safety;

·         Where we reasonably suspect that unlawful activity has been, is being or may be engaged in and the use or disclosure is a necessary part of our investigation or in reporting the matter to the relevant authorities;

·         Where such use or disclosure is required under or authorised by law (for example, to comply with a subpoena, a warrant or other order of a court or legal process);

·         Where we reasonably believe that the use or disclosure is reasonably necessary for prevention, investigation, prosecution and punishment of crimes or wrongdoings or the preparation for, conduct of, proceedings before any court or tribunal or the implementation of the orders of a court or tribunal by or on behalf of an enforcement body;

·         Where we are required to comply with demands for information as required by law

You give Your consent for Us to share personal information to third parties with Third Party Service Providers where this is reasonably necessary for us to provide our services. If you are a User in a Customer’s Organisation or Group, You consent to the Group rules that might be set for You and to the collection and use of data to facilitate the functions of our software and help monitor and enhance safety and process aspects when using our Product(s) and Service(s) being undertaken by You while you use the SafeTAG CEC App or an associated product or service.

We may disclose personal information to:

·         trusted partners and our service providers for the purpose of enabling them to provide their services, including (without limitation) IT service providers, data storage or management, web-hosting and server providers, debt collectors, maintenance or problem-solving providers, data analytics, cyber security providers, project management or collaboration providers, testing, research and alert tools, email service providers and payment systems operators;

·         our existing or potential agents or organisation partners;

To address fraud, security or technical issues

We will share your personal information with trusted third parties where necessary to detect, prevent or otherwise address fraud, security or technical issues.

For legal reasons

We may disclose your information if required by applicable law, regulation or as part of any actual or prospective legal process (including if reasonably necessary to enforce applicable Terms of Service or in order to establish, exercise or defend our legal rights). If we receive a request from a regulatory body or law enforcement agency, and if permitted under GDPR, the CCPA and other laws, we may disclose certain information to such bodies or agencies.

Merger or acquisition

If we merge with or are acquired by another organisation, we may share your personal information with the new owners of the organisation and their advisors. We will continue to ensure the confidentiality of any personal information and give affected users notice (for example, via a message to the email address associated with your account) before personal information is transferred or becomes subject to a different privacy policy.

We may share aggregated, non-personally identifiable information publicly and with our partners – like publishers, advertisers or connected sites. For example, we may share information publicly to show trends about the general use of our services. This could also include government bodies, industry groups, insurers and research or educational/training facilities.

Security

Parts of this Product(s) and Service(s) transmit information securely across the internet. However, this is not always feasible. You recognise and accept that there may be risks transmitting information across the internet.

Information security

We have put in place robust measures regarding the security of the information we collect and store about you (including through the use of network and database security measures) and will use our reasonable endeavours to protect your personal data from unauthorised access to or unauthorised alteration, disclosure or destruction.

In particular:

We encrypt many of our services using Secure Sockets Layer (SSL) or Transport Layer Security (TLS). SafeTAG CEC encrypts data while at rest and in transit both on your device and on the Server.

We review our information collection, storage and processing practices, including physical security measures, to guard against unauthorised access to systems.

We restrict access to personal information to our employees, contractors and agents who need to know that information in order to process it for us, and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.

We use multifactor authentication and access control measures to ensure data is only accessed by authorised personnel and at times when authorised.

The transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our servers via third party networks; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

A reliable internet connection is required to set, edit and stop programs in SafeTAG CEC including SOS, and some functions operate with precise location activated. Where this site contains links to other third-party websites and trusted partners and service providers, the privacy or security terms set out there will apply to the material on their websites. Where this site contains links to these websites, Raise DM is not responsible for the privacy or security practices or the content of any such URLs or websites.

This Privacy Policy May Change

Raise DM may need to update this Privacy Policy to keep pace with changes in the Product(s) and Service(s), our organisation and laws applicable to us and You. We will, however, always maintain our commitment to respect Your privacy. We will post any revisions to this Policy, along with their effective date, in an easy to find area within our Product(s) and Service(s) and on our Website, so We recommend that You periodically check back here to stay informed of any changes. We will ask for Your consent to such changes if required by applicable law; in other cases, please note that Your continued use Raise DM Product(s) and Service(s) or continuing Your account after any change means that You agree with, and consent to be bound by, the new Privacy Policy. If You disagree with any changes in this Policy and do not wish Your information to be subject to the revised Policy, You will need to close Your account. Finally, when You access Raise DM  Product(s) or Service(s) or use a Raise DM  Software application, that application will request access to certain information on Your mobile device, including residual battery charge and GPS location data. You need to agree to this access to access the full functions within the Mobile Application(s).

What Is Raise DM’s Approach to Information Collected From Children?

Raise DM does not knowingly collect personal information from children under the age of 13 years without parental or supervisor consent. Raise DM  Product(s) and Service(s) are not directed to children under 13 years, and we expect that use by children will only be done with the guidance, supervision and consent of their parents, guardians and/or authorized school officials. Further, we rely on parents and guardians to ensure minors only use the Service if they can understand their rights and responsibilities as stated in our Terms and Conditions and our Privacy Policy.

Will Raise DM Contact Me?

From time to time, We may contact You via email with information about product announcements, service offerings that We think may be beneficial to You, software updates and special offers. We also may contact You with information about products and services from our organisation partners. We consider Your acceptance of this Privacy Policy as Your acceptance of our offer to send You these emails. You may be added to a mailing list for this purpose. You may unsubscribe from promotional emails at any time. You will continue to receive essential Service related and account related information, even if You unsubscribe from promotional emails. You are able to delete any Contact and you can also unsubscribe from any event notification using the Alert Detail Screen.

Information Access and Disclosure

Raise DM does not sell or rent Your information. Outside of actions You take within the Service to communicate using a Product or Service, to share files or process information, or to authorise third-party applications, We only disclose Your information – and then only the minimum information necessary and when:

·         We have Your explicit consent to share the information.

·         We need to share Your information with service providers who process data on our behalf in order to operate the Service, complete Your payment transactions, and help us communicate with You as described elsewhere in this policy; these providers are subject to strict data protection requirements in keeping with our commitments to Your privacy.

·         We need to share Your information with service providers to fulfill Your product or service requests, including sales, delivery and support for certain products from the Raise DM.

·         We believe it is necessary to investigate potential violations of our Terms and Conditions, to enforce those Terms and Conditions, or where We believe it is necessary to investigate, prevent or take action regarding illegal activities, suspected fraud or potential threats against persons, property or the systems on which We operate the Product(s) and Service(s).

·         We determine that the access, preservation or disclosure of information is required or permitted by law to protect the rights, property or personal safety of Raise DM and users of our Product(s) and Service(s), or is required to comply with applicable laws, including compliance with warrants, court orders or other legal process.

·         We do so in connection with the sale, merger or reorganization of all or part of our organisation, as permitted by applicable law.

Data Storage

When You use Raise DM Product(s) and Service(s) on Your mobile device, such as SafeTAG CEC app, Content You save will be stored on the Server. Please be aware that personal Information and content submitted to Raise DM may be transferred to a trusted partner such as our AWS servers. If You post information to the Raise DM platform, You are confirming Your consent to such information, including Personal Information and Content, being transmitted to, hosted and accessed according to the rules and regulations that these servers adhere to.

If Raise DM  learns of a security system breach, we will notify You and provide information on protective steps, if available, through the email address that You have provided to us or by posting a notice on our web site and/or via other communication platforms. Depending on where You live, You may have a legal right to receive such notices in writing.

How Does Raise DM Respond To Copyright Or Other Intellectual Property Violations?

We respond to clear and complete notices of alleged infringement of copyright, trademark or other intellectual property laws that satisfy the requirements in these Terms and to comply with the any Copyright Laws and other applicable laws that apply. If You believe that Your intellectual property rights have been violated, please notify Us and we will investigate. Note that each owner of intellectual property is responsible for protecting their rights and taking any legal or other action they determine to be appropriate to do so, and Raise DM does not accept any obligation to take any particular action to enforce or protect any party’s intellectual property rights on their behalf.

Correction

If you believe that any information, we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us using the details below. We will take reasonable steps to correct any information found to be inaccurate, incomplete, misleading or out of date.

Complaints

If you believe that we have breached the Australian Privacy Principles and wish to make a complaint, please contact us using the details below and provide us with full details of the alleged breach. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take to deal with your complaint.
